Conveyancing Explained

Conveyancing is the term used to describe the transfer of property ownership, which includes both the buying and selling of a home. We are here to handle all the legal aspects on your behalf.

Our aim is to make the transaction as hassle-free and straightforward as possible.

There are a number of stages in the process, all of which may vary according to the circumstances of your transaction, including whether there are a number of parties in your property chain.  There is no average timescale, but we would advise you that it may take between twelve and twenty weeks to move house.  Sometimes additional circumstances arise with particular transactions.  If that happens we will update you as soon as possible.

The stages of the process, that are all included in our standard fees and fee estimates provided to you are as follows:

Instructing Solicitors -

Once an offer has been made and accpeted, the parties will instruct their chosen solicitor who will open their file, which will include identity checks and anti-money laundering procedures, in compliance with regulatory matters.

Pre-Contract -

After an offer is made on a property and the parties instruct their solicitors, the sale contract is prepared by the seller's solicitors, and issued to the buyer's solicitors together with the seller's information forms.  Searches and investigations are carried out by the buyer's solicitors, who will also receive any mortgage lender's instructions and mortgage offer.  When all enquiries are satisfied the parties can move towards exchange of contracts.

Exchange of Contracts -

At this point, you will enter into a binding contract for the sale and purchase of the Property and the buyer's deposit will be paid.  This is usually 10% of the purchase price and is either held by the seller's solicitors or used for their onward purchase.

Before completion -

We will make sure everything is ready for you, including preparing the legal documents to transfer ownership, making arrangements for the transfer of funds and completing final Land Registry checks.

Completion -

We will make sure the process during completion stage progresses as smoothly as possible, and ensure that the legal documents are in place to transfer ownership and that mortgages are either secured or redeemed.

After-Completion -

We will deal with all post-completion formalities on your behalf including paying Stamp Duty Land Tax and applying to register ownership at land registry.
